TERMS & CONDITIONS

 

1  GENERAL

1.1 These terms and conditions applies to all contracts for the sale of goods and services entered into by Home Atelier Pte Ltd, registered in Singapore hereinafter referred to as 'Home Atelier‘ or as 'The Company’. These terms and conditions apply in preference to and supersede any terms referred to, offered or relied on by either party whether in negotiations or at any stage in the dealings between The Company and the Buyer with reference to the sale of goods or services unless confirmed otherwise in writing via email and reflected on the Purchase Invoice as such.

1.2 This constitutes the entire agreement between the parties relating to its subject matter. The Buyer acknowledges that it has not entered into an agreement on the basis of and does not rely on any representation, warranty or other provisions that is not expressly included in the terms and conditions set forth unless clearly stated otherwise in the Purchase Invoice and confirmed in writing via email by The Company as such. Any delay or failure by us to exercise our rights does not represent a waiver of any of our rights. We shall be considered to have waived our rights only if we specifically notify you of such a waiver in writing.

1.3 The Company reserves the right to change and update these terms and conditions from time to time without notice to you and any changes will take effect on the day they are posted. For this reason we encourage our customers to review them at the point of purchase to ensure that they are familiar with the latest terms and conditions.

1.4  The product features presented  by The Company or otherwise configured by the Buyer do not constitute a binding offer of contract except when confirmed in writing and clearly stated as such on the Purchase Invoice after payment is made.

1.5 The Purchase Invoice will be sent to the Buyer after payment has been received. Any discrepancies within the Purchase Invoice must be communicated to us via email within 24 hours which it is sent. Failing which the Buyer is deemed to have accepted that the sales descriptions as set out in the Purchase Invoice is true and correct.

2  GOODS

2.1 All descriptions of the Goods are given by way of identification only and the use of any such description shall not constitute a sale by description. The Company maintains a policy of continuous product improvement and reserves the right to alter specifications without notice at any time before delivery to any other specifications unless the specifications being referred to is clearly stated specifically in the Purchase Invoice. This refers to instances when an order has been made for an older furniture model which is either out of stock or discontinued to be replaced with an upgraded furniture model both bearing the same model number with the difference being minor cosmetic, measurement or features changes. This includes but not limited to changes of design to sofa legs and wardrobe handles. Any specific furniture wood type mentioned is also subjected to availability and may be substituted with a similar wood type at our discretion unless the wood type is specifically stated on our Sales Purchase Invoice.

2.2 For all furniture products with wood frames. Whereby every possible
care will be undertaken to ensure the dimensions of our furniture are built to
the dimensions as per stated on our listing or on our Sales Purchase Invoices.
During the course of production, in view of the high level of manual craftsmanship
involved in the production of your furniture some variances in length and width
might occur not amounting to plus or minus 15% of the stated dimensions. The
overall dimensions might also vary due to the choice of fabrics and cushioning
while maintaining the original furniture’s design and shape profile. You agree
to allow our furniture production team full discretion with regards to the
final furniture dimensions within this 15% limit

2.3 For all Customized Furniture Products with wood frames. Whereby
every possible care will be undertaken to ensure the dimensions of the
Customized Products are built to the dimensions as per our discussion or on our
Sales Purchase Invoices. During the course of production, some variances in
length and width might occur not amounting to plus or minus 13% of the stated
dimensions as all Customized furniture frames are manually crafted by hand and
the overall dimensions might vary due to the choice of fabrics and cushioning
while maintaining the original furniture’s design and shape profile. The
Customized Furniture dimensions might also need to be revised to adhere to our
Furniture Safety Standards. You agree to allow our furniture production team
full discretion with regards to the final furniture dimensions within this 13%
variance limit.

2.4 For all our furniture models having steel or metal frames including
but not limited to sofa and sofa beds some variances in length and width might
occur not amounting to plus or minus 10% of the stated dimensions.

2.5 For all our build to order or customized sofa pillows and cushions,
whereby every possible care will be undertaken to ensure the dimensions are
built to the dimensions as stated. During the course of production, some
variances in length and width might occur not amounting to plus or minus 20% of
the stated dimensions as these orders are handmade and the overall dimensions
might also vary due to the choice of fabric and cushion filling while
maintaining the original pillow or cushions shape profile.

2.6 For all build to order or customized furniture products, dimensions
given which include the cushioning system for example high density foam or
microfiber fillings might vary significantly after use. This is not a defect
and there will be strictly no exchanges or refunds with regards to this matter.

2.7 Payment paid is strictly non-refundable for Build to Order and Customized Furniture Products as preparations for your order will have begun once payment is received.

2.8 Deposit paid is strictly non-refundable for Build to Order and
Customized furniture products. This includes furniture models which have yet to be confirmed
fabric colors or other unconfirmed furniture details as preparations for your order will have begun once deposit payment is received.

2.9 For customized or made to order products, production would be either
at our carpentry workshop facilities in Malaysia, Vietnam or China. The Company
has full discretion in the scheduling of either carpentry workshops for the job
base on workshop capacity, manpower and other logistics considerations.

2.10 For all our leather furniture products, our leather rolls for the
same colour code do vary from the dying process from batch to batch. As such
the leather furniture you order might not be the exact shade of colour if you
are ordering more than 1 piece of furniture. Actual colour of the leather
furniture received might also vary from the listed photos in our listings for
the same reasons.

2.11 For all our fabric upholstery, our fabric rolls for the same colour
code do vary from the dying process from batch to batch. As such the fabric
upholstery you order might not be the exact shade of colour if you are ordering
more than 1 piece of furniture. Actual colour of the fabric upholstery received
might also vary from the listed photos in our listings or our fabric sample
swatches for the same reasons.

2.12 For advertising purposes, sofa pillows, cushions or any accessories
might be photographed together with our furniture sofas for marketing and
advertising purposes. These sofa pillows, cushions or accessories do not come
together with the sofa unless our listing clearly says so.

2.13 For all sofa pillows and cushions which are included as part of your purchase we reserve the right to substitute the fabric type and design of all sofa pillows and cushions to another fabric type and design of equivalent
value.

2.14 Sofa pillows or cushions listed as complimentary are given subjected to fabric, colour and type availability. Customers are not able to choose either the fabric type or fabric colour for any complimentary sofa pillows or cushions given.

2.15 For marketing and advertising purposes, our furniture photos posted
may be edited by photo editing software which may enhance the features, colours
or stretch the dimensions of our furniture. These marketing and advertising photos are strictly for illustrative purposes only. Kindly refer to our unedited photos of past furnitures delivered to our customers for a more accurate representation of what you will be receiving.   If unedited photos are not provided as part of our listings, you may request for them prior to purchase. You may also request to view our fabric swatches for a more accurate representation of the
fabric colour you will be receiving if your furniture colour is of the essence to your purchase decision.

2.16 For certain furniture models, there may be add on options available for purchase. While we strive to fulfill each and every option request where possible, there might be times where the option request cannot be fulfilled due to stock availability. In such cases, the money paid for the add on options will be refunded and the furniture purchase will still proceed. No cancellation of a purchase order is allowed due to a non-availability of an add on option.

2.17 We offer a wide variety of customization services. For length customization, the furniture profile with distinctive curve shapes furnitures will likely vary from the original furniture design as the dimensions vary from the original furniture dimensions. For fabric customization, the external design appearance of the customize furniture might vary from the original furniture design depending on the fabric characteristics of the customize fabric chosen. For example, linen cotton fabric blends have a higher degree of stretch compared with leather fabrics. As such this will affect the furniture profile and design due to the manner the fabric is able to be upholstered around the furniture frame. For all customized furniture products we will try to keep to the original furniture profile or designs but we cannot guarantee it will be an exact replica of the original furniture’s profile, design or stitching lines.

2.18 For customized sofa length, the number of seating cushions including the number of back cushions may vary based on the customized sofa length. You agree to allow our furniture production team full discretion with regards to the final number of seating cushions and back cushions to adhere to
your customized sofa length request.

2.19 For all sofa leg customization requests, if the original sofa design has legs which are located or visible other than from the base of the sofa. Our furniture production team reserves the right to change or alter the designs of the entire external panels of the sofa not limited to the sofa arm
rests panels. 

 

3  DELIVERY

3.1 All outstanding payments if any must be made in full prior to the scheduling of the delivery.

3.2 The Company will deliver the Goods to the delivery address during our delivery team’s or third party logistics contractor’s working hours by any method of transport at the Company’s discretion and if assembly services are included or purchased as part of the sale, assemble them or arrange for their assembly. The Company reserves the right to make part deliveries on delivery day due to any
unforeseen circumstances.

3.3 If a Delivery Date is specified after we received confirmation from our third party shipping logistics company, we will aim to dispatch the goods by then, but we do not guarantee to do so. Products dispatched from our overseas factories are handled by our third party shipping logistics company and arrive in Singapore via Container Ship except from our Malaysia factory. Whereby every possible effort will be made by them to adhere to the shipping time confirmation, shipping delays do happen from time to time. We reserve the right to revise the shipping time when informed of any unforeseen shipping delays by them as this would affect our scheduled delivery date with you.

3.4 Time of delivery shall not be of the essence of the contract and the Company will not be liable for any direct or indirect consequential losses incurred due to any shipping delay. 

3.5 There will be strictly no compensation for any shipping delays unless shipping delays exceed 120 days from the Purchase Invoice Date. Compensation will only be offered to customers who did not request and receive any loan furniture from us during the shipping delay period.

3.6 Delivery timings are split into 2 delivery slots. Either a Morning delivery slot between 9am-12pm or an Afternoon delivery slot between 1pm-5pm. Buyers are able to choose either a Morning delivery slot or an Afternoon delivery slot only. We are not able to schedule for specific time deliveries (eg. Buyer requesting delivery for a specific time of 2pm only) for any delivery advertised as free delivery or for customers who  purchased our Normal Delivery Service.  

3.7 Customers who are only able to accept deliveries at a specific time may opt for our Premium Delivery Service. There will be an additional charge of $120, this amount will be in addition to customers who purchased our Normal Delivery Service or customers who qualify for free delivery. We would require a minimum of 2 working days to arrange this service.

3.8 For all International Deliveries (excluding Singapore) the delivery
will be exclusively carried out by our third party logistics contractors . They
will attempt to deliver anytime between 9am-9pm on delivery day, we are not
able to schedule for specific time deliveries. Any furniture purchases not
scheduled for delivery (delivery date must not be more than 5 days after it
arrives at port) within 5 days of port arrival will incur a daily charge of $75
Singapore Dollars per Cubic Meter. Any outstanding payments must be made in
full prior to the scheduling of the delivery. This includes any regulatory
taxes such as import taxes, custom taxes and port taxes levied on our third
party logistics contractors. Our third party logistics contractors reserve the
right to dispose of any furniture item not delivered within 30 days of port
arrival without any compensation to you (maximum paid storage period is 25 days
plus 5 free storage days).

3.9 For all International Deliveries (excluding Singapore), you will
have to assemble and setup your furniture purchase yourself. Our third party
logistics contactors strictly provide only delivery services, they will not
unpack or uncrate any of your furniture items. Any missed delivery will incur a
missed delivery fee of $200 Singapore Dollars. This missed delivery fee will
have to be paid prior to the scheduling of any future delivery up to a maximum
of 2 missed deliveries only. After which your furniture may only be
self-collected at their warehouse.

3.10  Free Delivery if stated or advertised refers to a single delivery of the purchased item stated or advertised as Free Delivery to a single address within Singapore at no additional charge. If the Buyer is not present at the delivery address during the scheduled delivery time or uncontactable or we are denied access to your building for any reason, this will be reflected as a missed delivery and there will be a re-delivery fee of $200 Singapore Dollars charged. This re-delivery fee also applies if an incorrect address is provided by the Buyer and we have delivered to the wrong address as given to us. We are not obliged to complete the delivery of your order prior to receiving payment of the re-delivery fee.

3.11 To qualify for Free Delivery, your delivery location must be accessible via
elevator (meaning to be on the same storey as elevator landing) or must be on
the same floor as the goods loading and unloading area. If our delivery team is
unable to send furniture to your location via the elevator at the point of
delivery (eg. furniture inclusive of protective wrapping or wood protective
frame is unable to fit into elevator, elevator not in service upon delivery team's
arrival, refusal of elevator access by building management etc) we will assess
at our own discretion the feasibility of the furniture being carried up via the
staircase. Staircase delivery fees of $50 per item per flight of stairs will
apply. Staircase delivery fees are also payable for the moving of furniture
requiring the use of staircases within the buyer’s home or office premises. If
carrying up by stairs is accessed by us to not be feasible for any reasons, the
item will be brought back to our warehouse. The furniture order will then only
be available for self-collection only by the Buyer or the Buyer’s appointed logistics
company at our warehouse or our third party logistics provider’s warehouse from
Monday to Friday between 1pm-6pm only. For furniture items which require 3 or more members of our delivery team to deliver by

3.12 For our Paid Delivery services, your delivery location must be accessible via
elevator (meaning to be on the same storey as elevator landing) or must be on
the same floor as the goods loading and unloading area. If our delivery team is
unable to send furniture to your location via the elevator at the point of
delivery (eg. furniture inclusive of protective wrapping or wood protective
frame is unable to fit into elevator, elevator not in service upon delivery
team's arrival, refusal of elevator access by building management etc) we will
assess at our own discretion the feasibility of the furniture being carried up
via the staircase. Staircase delivery fees of $50 per item per flight of stairs
will apply. Staircase delivery fees are also payable for the moving of
furniture requiring the use of staircases within the buyer’s home or office
premises. If carrying up by stairs is accessed by us to not be feasible for any
reasons, the item will be brought back to our warehouse. The furniture order
will then only be available for self-collection only by the Buyer or the Buyer’s
appointed logistics company at our warehouse or our third party logistics
provider’s warehouse from Monday to Friday between 1pm-6pm only.If the furniture item requires 3 or more of our delivery guys to deliver by stairs, there will be an additional surchage of $150 per flight of stairs payable.

3.13 In the event that there is a missing item in your order (eg. sofa legs) at the
point of unpacking at your premises, The Company will strive to arrange a re-delivery
of the missing item to you as soon as possible at no additional cost. In this
event, our assembly guys will set up your order excluding the missing part or
parts and we will reschedule another date for assembly of the missing part or
parts.    

3.14 If our logistics team or third party logistics provider is denied
reasonable access to your location (such as but not limited to having to
physically transport the items a long distance away from the delivery vehicle
parking location), additional fees will be applicable which will be advised on
the spot, payable directly to The Company via PayNow. We are not obliged to
complete the delivery of your order prior to receiving payment of the reasonable
delivery access fee. This applies to both Free Deliveries and Paid Deliveries.

3.15 It is the Buyer’s responsibility to obtain any relevant permits or permissions
from the building management committee prior to the delivery date. If our
delivery guys are refused access to your delivery address by either your
building management or building security on delivery day, this will be counted as
a missed delivery and missed delivery charges will apply. Additionally
if there are any deposits required to be paid to your building management
before delivery, it will be arranged by you, our delivery team or third party
logistics providers will not be obliged to do so. This includes security
deposit for lift cladding etc. For all deliveries, there will be a maximum
standard delivery time of 30 minutes which includes waiting for management
approval paperwork or the wait time to be able to obtain use of the lift
cladding etc. We reserve the right to reschedule the delivery with a missed delivery
fee payable if the waiting time is beyond 30 minutes.

3.16 Our Lift Cladding charge is fixed at $35, this includes the collection, setting up
and return of the lift cladding material.

3.17 The company reserves the right to allow for a maximum of 2 missed
deliveries only. Items which missed 2 scheduled deliveries will be made available
for self-collection only by the Buyer or the Buyer’s appointed logistics
company at our warehouse or our third party logistics provider’s warehouse from
Monday to Friday between 1pm-6pm.

3.18 We have a free 7 Day Storage policy for items shipped from our overseas factories.
Once we have emailed or contact you via whats app that your product is ready
for delivery, if your scheduled delivery date exceeds 7 days from this email or
whats app message, daily storage charges of $10 per pallet (Our pallets have
measurements of approximately 1 meter by 1 meter) will apply from the 8th day
onwards. Storage charges are to be paid in advance, the first payment on the 8th
day and subsequent payments everyday up to a maximum of 60 days of paid
storage. These storage charges and terms and conditions also apply for any
furniture order that have to be returned to our warehouse or our third party
logistics warehouse for any reasons. Storage charges will be incurred on the
day the furniture order has to be returned to our warehouse or our third party
logistics warehouse. Any product not scheduled for delivery within the maximum
60 days of storage time frame will be deemed unwanted and will be disposed
off without compensation. This includes both free and paid storage. Delivery can only be scheduled once all outstanding payments
are paid in full.

3.19 For all furniture items that have been left in storage either at our warehouse or
our third party logistics contractor’s warehouse for longer than 15 days, you agree to indemnify us and our third party logistics contractor for any long term storage issues such as but not limited to mould, fabric discolouration and pests infestations etc.

3.20 In the event that our warehouse or our third party logistics contractor’s
warehouse is full, we reserve the right to refuse any long term storage
requests after our free 7 Day storage period ends. Your furniture may be
transferred to any available warehousing storage company in Singapore without further
notice to you if no arrangements were made for either delivery or collection
after the free 7 Day storage period. You agree to pay for all costs involved.

3.21 On delivery day, it is your responsibility to examine the furniture, check the
condition of the packaging, ensure that the correct number of packages has been
delivered and ensure that the furniture delivered to you is free of defects.
You will be asked to sign the Delivery Note to confirm this. If there are
any defects, accidental damages or anything you are unhappy about you should
make this be known to the delivery team and detail this accordingly on the
Delivery Order and inform us via email on the same day. Any issues reported
after the delivery and not reflected on our Delivery Order Form will only be
addressed within the scope of our limited warranty programme if the furniture
is covered by our limited warranty programme.

3.22 Please make plans to be available to accept your delivery. If you are not available,
there must be a person that is capable of receiving delivery on your behalf,
and you agree that we can rely on such person's instructions as if they were
your own.

3.23 In the event of any unforeseen circumstances (such as lorry breakdown, traffic
accident, major traffic delays or severe weather) we will do our best to
contact you to rearrange an alternative delivery date and time slot. There will
be no compensation for this delay.

3.24 Before the delivery, please ensure that there is sufficient access and space and that
any staircases and lifts providing access are suitable for the delivery. Please
move objects which could be damaged during the delivery, such as lights, vases,
pictures et cetera and ensure there is sufficient space in the property for
delivery and assembly. If you require our courier to move the items around for
you, additional charges will apply at $20 per item, this is subjected to staircase
delivery fees for multi-story houses or apartments with regards to delivery by
flight of stairs within the multi-story house or apartment of $50 per item per
flight of stairs.

3.25 Our delivery team will not use any specialized lifting equipment to remove any
fixtures at the stipulated address (e.g. doors, windows, door frames etc.) in
order to complete the delivery. If any of such equipment or removals is
required, you must arrange these before the delivery takes place. Furniture not
able to be delivered after these efforts by the buyer will only be able to be
placed in storage and be arranged for self-collection. Our terms and conditions
for Storage apply If we are unable to deliver because of these reasons, a
missed delivery fee is applicable.

3.26 Furniture protective wrappings or wood protective frames which protects the
furniture from damages may only be removed in the buyer’s premises to prevent
damages to the furniture when moving through the entrance doorway of the lift
and the entrance doorway of the customer’s premises. In the event that the
furniture which it is wrapped in protective wrapping or framed with a wood
protective frame is unable to enter the lift we will assess the possibility of
delivery by staircase subjected to staircase delivery fees. Furniture not able
to be delivered via staircase wrapped in protective wrapping or framed with a
wood protective frame will only be able to be placed in storage and be
available for self-collection only by the Buyer or the Buyer’s appointed logistics
company at our warehouse or our third party logistics provider’s warehouse from
Monday to Friday between 1pm-6pm. Our terms and conditions for Storage will apply.
In the event the furniture which it is wrapped in protective wrapping or framed
with a wood protective frame is unable to enter the entrance doorway of our
customer’s premises we will assess the entrance doorway of the customer’s
premises and may at our discretion agree to removing the protective wrapping or
wood protective frame to facilitate the moving of the furniture through the customer’s
premises entrance doorway provided we are indemnified by the customer for any
accidental damages that might occur as a result. Furniture not able to be
delivered with or without the protective wrapping or the wood protective frame
through the customer’s premises entrance doorway will only be able to be placed
in storage and be available for self-collection only by the Buyer or the Buyer’s
appointed logistics company at our warehouse or our third party logistics
provider’s warehouse from Monday to Friday between 1pm-6pm. Our terms and
conditions for Storage apply

3.27 In the event that your furniture has to be delivered via stairs. While every
effort will be taken by us or our third party logistics contractors to deliver
your furniture in good order and condition to the best of ability, you agree to
indemnify us and our third party logistics contractors from any accidental
damages that might occur.

3.28 In the event that any furniture wrappings or wood protective frames protecting
your furniture from accidental damages during delivery have to be removed to
facilitate the delivery before entering your delivery address entranceway.
While every effort will be taken by us or our third party logistics contractors
to deliver your furniture in good order and condition to the best of ability,
you agree to indemnify both us and our third party logistics contractors from
any accidental damages that might occur as a result of the removal of any
furniture wrappings and wood protective frames.

3.29 Protective wrappings or wood protective frames may only be removed by members of our
Company’s delivery or assembly team. We will not be liable for any accidental
damages incurred if the Buyer chooses to remove any protective wrapping or
protective frames on their own.

3.30 If you are concerned about possible damage to the Property (e.g. flooring etc.)
during the delivery, please make sure you cover the property (e.g. flooring
etc.) with protective sheets. Our delivery or installation team have the right
to decline the delivery or installation if damages are likely to your property
without adequate protection (eg. flooring covers and doorway cladding). A fixed
refund of $55 will be refunded for any delivery advertised as Free Delivery and
the furniture will only be made available for self-collection by the Buyer or
the Buyer’s own logistics company only as a result. Storage charges will apply

3.31 While our delivery team or third party delivery contractors will be very careful in delivering your furniture order. Accidental damages do happen from time to time. You agree to indemnify our delivery team or third party delivery contractors to a maximum compensation of either 5% of your furniture purchase price or $200 which ever is lower for any accidental damages caused.

3.32 Our team will carefully install your new furniture in your home, exactly where
you want it (subject to access). They will also remove all wrappings and
packaging and dispose of them accordingly for you only at your request. We can
help to dispose of your unwanted furniture. Kindly email us a photo of the
furniture you need to dispose off with its approximate dimensions for a
quotation. All disposal services fees must be scheduled and paid in full at
least 1 day prior to the delivery day.

3.33 Our Disposal Service Fee only applies to furniture that are transportable away
via elevator (meaning to be on the same storey as elevator landing) or must be
on the same floor as the goods loading and unloading area. If our delivery team
is unable to move your furniture via elevator (eg. furniture is unable to fit
into elevator, elevator not in service upon delivery team's arrival, refusal of
elevator access by building management etc) we will assess at our own
discretion the feasibility of the furniture being moved via stairs. Staircase
moving fees of $50 per item per flight of stairs will apply. Staircase moving
fees are also payable for the moving of furniture requiring the use of stairs
within the buyer’s home or office premises. If moving by stairs is accessed by
us to not be feasible for any reasons, your Disposal Service Fee will be partially
refunded.

3.34 For any changes and cancellation of delivery schedule, please contact us at
least 1 day prior to delivery day to reschedule. Cancellation of delivery
services is not allowed on the scheduled delivery day itself. Missed delivery
charges will apply. Any item which qualifies for free delivery will be
available for self-collection only.

3.35 For any changes and cancellation of service appointments, please contact us at
least 1 day prior to the appointment day to reschedule. Cancellation of service
appointment is not allowed on the scheduled day itself and any service fees
paid will be forfeited without exception

3.36 You agree that any assembly or setting up of the furniture will be done by you
or your own contractors at a later date if you instruct our delivery team to
not unwrap or setup your furniture at the point of delivery for any reasons. By
doing so you also agree to indemnify us from any discrepancies or accidental
damages found later. We will also not be liable for any improperly installed
furniture fittings done by you or your contractor and we reserve the right to
decline any repair requests.

3.37
For all customer who choose to self-collect their furniture , you agree that
any assembly or setting up of the furniture will be done by you or your own
contractors. We will not be liable for any improperly installed furniture
fittings done by you or your contractor and we reserve the right to decline any
repair requests.

3.38 We will not warranty any furniture parts which are not installed by our furniture
delivery team

3.39 If you instruct our delivery team to leave your furniture at any other location
other than in your home for example but not limited to your house gound floor
common area or car park parking lot for any reason you agree to indemnify us
for any accidental damages to the furniture and 
the common area property

 

4  DAMAGED OR DEFECTIVE GOODS

4.1 Every effort will be made to ensure that the goods you have ordered arrive undamaged and without defect. If the goods are found to be either damaged or defective in any way at the time of delivery, you must inform our delivery team at the point of
delivery and via email to us on the same day as per our claim procedures set
out in our T&C.

4.2 Accidental damage claims reported to us after our delivery
team or third party logistics providers have left your premises and are unable
to verify and document in person will not be accepted.

4.3 If you choose to sign the Delivery Note without checking your furniture for any reasons, you agree to indemnify us from any discrepancies or accidental damages found on your furniture after our delivery team have left your premises.

4.4 If the goods are found to be defective we will either exchange or repair the item to manufacturing standards. Home Atelier warrants that all furniture to be free of defective materials and workmanship. Warranty periods vary by product.

4.5 If during the warranty period, a product is deemed defective due to a manufacturing defect, Home Atelier will repair or replace part(s), at Home
Atelier’s option. Our limited warranty covers the replacement or repair of any
product that has a manufacturing or material defect that is not the result of
normal wear and tear, misuse of product, or a natural characteristic of the
material used. Only transport and labour costs are payable. Our limited
warranty do not cover High Density Foam Cushioning due to the material’s
condition and life span highly dependent on the usage of the Buyer. For any
fabric stitching, our limited warranty only covers broken stitches we deem not
the result of accidental damage. Fabric stitching patterns are strictly not
covered under our Limited Warranty programme.

4.6 This warranty is not transferable and any subsequent purchaser buys the product ‘As Is’, without the protection of the Warranty. Additionally our warranty does not cover products used for commercial purposes. This includes furniture purchases bought via proxy for any business related reasons (eg housing agent buying for a rental property)

4.7 If the goods are found and proven to be accidentally damaged
during the delivery. Depending on the severity of the damage, the visibility of
the damaged area and whether the damage affects the normal functioning of the
furniture. The Company will at its discretion offer to repair, replace or to
reduce the price of the furniture.

4.8 In cases where the delivery is outsourced to our third party
logistics providers and is covered by Accidental Damage Policy, the Company will
first proceed to claim against the Accidental Damage Policy on the Buyer’s
behalf if there are any accidental damages found at the point of delivery. The
claim process will take approximately between 4 weeks to 6 weeks. Except in
cases where the accidental damage poses a safety hazard, any offer from us to
repair or replace or to reduce the price of the furniture will only be offered
after the Accidental Damage Policy claim is processed and completed.  

4.9 For all Build to Order furniture products and Customised
Order furniture products, Accidental Damage Policy will only cover either the
repair cost or be in the form of cash compensation for any accidental damages
as per the relevant sections as listed below. The offer of either a repair or
cash compensation will be determined at our discretion. There will be no
replacement of the furniture bought.

4.10 For impact damages to high density foam, wood, metal and
stone furniture surfaces for furniture that cost below $1000 there will be a
fix compensation of $55 for all scratches and impact damages below 5cm and a
fix compensation of $75 for all scratches or impact damages above 5cm. The
compensation for scratches or impact damages for furniture that cost above
$1000 will be twice that of furniture that cost $1000 or less. Total
compensation for scratches or impact damages for any furniture product cannot
exceed 20% of its invoice price.

4.11 For tears or scuffings to any fabric material for furniture
that cost below $1000 there will be a fix compensation of $45 for tears and
scuffing damages below 5cm and a fix compensation of $65 for  tears or scuffing damages above 5cm. The compensation for scratches or impact damages for furniture that cost above $1000 will be twice that of furniture that cost $1000 or less. Total compensation for tears or scuffings for any furniture product cannot exceed 20%
of its invoice price.

4.12 For tears or scuffings to any leather material for furniture that cost below $1000 there will be a fix compensation of $55 for tears and scuffing damages below 5cm and a fix compensation of $75 for  tears or scuffing damages above 5cm. The compensation for scratches or impact damages for furniture that cost above $1000 will be twice that of furniture that cost $1000 or less. Total compensation for tears or scuffings for any furniture product cannot exceed 20%
of the furniture’s  invoice price.

4.13 For any accidental tears to the sofa base cloth found at
the point of delivery, our delivery team will repair the tear with fabric tape.
There will be no replacement of the sofa base cloth for tears which are less
than 18cm wide.

4.14 For any stains or discolouration damage to any fabric or
leather furniture there will be a fix compensation of $45 per stain for any
stains that are found at the point of delivery that we are not able to remove
successfully. The total compensation for any stains or discolouration damages
to any furniture product cannot exceed 20% of its invoice price.

4.15 For all furniture with any electronic features which
includes  but not limited to USB charging port, Bluetooth speakers and power outlets which are found to be defective at the point of delivery. If the electronic feature is deemed to be unserviceable by our furniture team there will be a fixed compensation payout of $80 per electronic feature not serviceable up to a maximum of 10% of the invoice price of the said furniture.

4.16 For all natural stone or glass furniture products that are deemed to be damaged beyond repair during delivery or installation there will be a co-payment damage sharing of 20% as we are unable to insure any natural stone or glass furniture products. The purchase price less 20% will be refunded to the customer. There will be no replacement.

4.17 For all furniture products containing glass panels as a
paid option that are deemed to be damaged beyond repair during delivery or
installation, the cost of the paid option will be refunded in full. There will
be no replacement of the glass panel option furniture product . There will be
strictly no compensation for the primary furniture bought.

4.18 For furniture purchases made with Credit Vouchers either in
part or full payment, any damage or defective goods compensation will only be
in Credit Vouchers

 4.19  Our Limited Warranty Programme only covers
the cost of any furniture parts that have to be replaced during the course of
the Warranty Period. This excludes any labour and transport costs incurred by
us or by our third party contractors. Our onward transport cost to your home is
fixed at $55 per trip and our labour cost is $35 per hour (minimum charge of 1
hour after which billing will be in blocks of 15 minutes) depending on the
amount of labour hours required to service the furniture. Payment has to be
made prior to the scheduling of any appointment.

4.20 Our Limited Warranty Programme strictly does not cover any forwarding cost if
your furniture repairs requires the furniture to be brought back to our
warehouse for any repairs that could not be done on site at your home.

4.21 For all our international furniture purchases (excluding Singapore), in order
to utilise our furniture Limited Warranty Programme you will have to arrange
transportation at your own cost to our designated repair facility in Singapore
without exceptions.

4.22 For all international furniture purchases (excluding Singapore), our third
party logistics contractors are liable for a maximum of either 5% of your
furniture purchase price or $200 Singapore Dollars for any accidental damages
caused (which ever amount is lower).

4.23 Unless stated otherwise, all our furniture comes with our 6 months Limited
Warranty Programme 

5  CLAIM PROCEDURE

5.1 Any claims will have to be
emailed to support@homeatelier.sg attached with 2 photos and a short video
clip of the issue accompanied with the invoice number. Please provide a single photograph
of the whole item (the whole furniture should be visible in the photograph). A
single close-up photograph of the defective area, or the area that requires
servicing or repairs. Plus a short video clip of the issue with verbal explanations.
We will request for more details when required. If you require our assistance
to go to your location for assessment purposes, an assessment fee of $90 shall
apply before our furniture team or our furniture contractor head down.

5.2 To utilise your Furniture Warranty,
there must not be any outstanding payments owed. We reserve the right to
decline any service requests if there are outstanding monies owed to us.

6  RETURNS AND REFUND POLICY

6.1  We want you to be completely happy with your
purchase. Unsatisfied with your purchase, requests for refunds should be made
within 30 days from the delivery date to be eligible. The refund will exclude
fees paid for delivery, assembly, staircase delivery, restocking fee, credit card transaction fees and any
other add on fees.

6.2  All products are eligible for returns,
exchanges or refunds EXCEPT for the following purchases:

i) Clearance Sale /
Display Sets / As-Is Products / Promotional Items

ii) Customized
Products (Including Fabric Colour Customization)

iii) Built to Order
Products

iv) Products that
require on-site assembly like sofa beds

v) Bed Frames and
Modular Wardrobes

vi) Products that are
not in new and unopened condition

vii) Products that
have been removed from their original packaging, stained, used, washed, torn,
dented, discoloured, damaged or with traces of fragrance and odors.

6.3 Home
Atelier has full discretion to decide whether any item is in a condition
suitable for return and reserves the right to reject any returns that we deem
unfit for return.

6.4 There will be a restocking fee of 25% of the price
you paid for the item.

 Refunded amount = Final Price Paid – Fees (If
any, for example Assembly Fee)  -
Restocking Fee of 25%

6.5 Refunds can only
be made via either Bank Transfer to any Singapore Bank Account or via PayNow to
the Buyer’s registered mobile number with the Company, not later than 5 working
days upon successful collection of the returned item. We are not able to do a
cash refund or Bank Transfer refund to any overseas Bank Account.

6.6 Once the full
refund or partial refund has been credited to you, this will constitute a full
discharge of all obligations from us to you

6.7 A request for Home Visit Fee refund can only be made if the request is made at least 48 hours before the appointment time

7  CANCELLATION BY US

7.1
We reserve the right not to accept or cancel any purchase order if:

i) We
have insufficient stock to deliver the goods you have ordered

ii)
We do not deliver to your area

iii)
One or more of the goods ordered was incorrectly described or priced on the
website;

iv)The
payment transaction is not authorized

v)
While every effort is made to meet our customers' demands, cancellations may be
necessary as a result of natural disasters, war, strike, lockout, labour
dispute, fire, flood, drought, or other causes beyond our reasonable control.

7.2
 If we do cancel your order we will notify you by e-mail and will refund to you any sum paid by you to us as reflected on the Purchase Invoice as soon as possible, and in any event within
30 days of the cancellation of your order. We will not be obliged to offer any
compensation for disappointment suffered or compensation for any losses to you as a result of this order cancellation.

INVALIDITY

If any part of these terms and conditions is unenforceable (including any
provision in which we exclude our liability to you) you agree that the
enforceability of any other part of these terms and conditions will not be
affected.

9 DATA PROTECTION AND PRIVACY

9.1 Information you provide to us remains confidential and we are committed to
protecting your privacy.

9.2 As such we are only able to take instructions from the primary mobile number
registered to your purchase and we reserve the right to exclude anyone other
than yourself on our Whats App chat.

9.3 You agree that any furniture delivery completion photos as taken at your home by
our delivery team may be used on our social media accounts

10 ENTIRE AGREEMENT

10.1 Unless agreed otherwise in writing between The
Company and the Buyer, these Conditions shall be incorporated in all contracts
of the Company to sell goods or services and together with the details recorded
on the Purchase Invoice, shall be the sole terms and conditions under which the
sale of goods and services takes place. All other terms and conditions or other
representations, whether written or oral, are excluded from the contracts
between the Buyer and The Company. In the event of any conflict or
inconsistency between a term proposed by the Buyer which is contained in any chat
with our sales executives and our term and conditions, the terms set forth here
shall prevail to the extent of the conflict or inconsistency.

10.2 Nothing said by any salesperson on our behalf should be understood as a
variation of these terms and conditions or as an authorized representation
about the nature or quality of any goods offered for sale by us.

10.3 Save for fraud or fraudulent misrepresentation, we shall have no liability for
any such representation being untrue or misleading.

11 LIMITATIONS AND EXCEPTIONS:

11.1 Proper care and usage are essential to preserving your rights under our Limited
Warranty Programme.

11.2 Our Limited Warranty programme commences on the date of delivery of our furniture
except for furniture held in storage for longer than 2 weeks in which our
Limited Warranty Programme commences on the first day of storage.  

11.3 The Company’s Limited Warranty programme does not cover damage resulting from
negligence, abuse, normal wear and tear or accidents: including but not limited
to burns, cuts, scratches, tears, scuffs, watermarks, indentations, pet damage
or the flexing of any wood frame due to excessive loading.

11.4 We will not be liable for any damage to property or injuries from improper
usage of furniture. For example, pushing bulky furniture that is not designed
for pushing may result in damage to property and injuries.

11.5 For all natural wood products its colour, grain and texture variations are
natural characteristics of authentic wood surfaces and are evident in every
piece of wood - making each piece unique. Natural wood products will exhibit
unique grains, scars, knots, splits and fissures. Thus wood products may vary
from product to product in appearance and colour and may differ from our listing
photos. Additionally as wood is a natural material and is a core component in
majority of our furniture pieces, slight variances in the delivered product's
measurements are normal.

11.6 For all products described and advertised as leather, the product photo
displayed may be full genuine cowhide leather if genuine cowhide leather is
listed as an option. If the buyer opts for any other option other than full
genuine cowhide leather, the colour hue and texture of the leather surface
might vary as genuine leather and faux leather dye differently with the same
colour dye solution.

11.7 All furniture products described as Leather are made of PU Leather also known
as Faux Leather unless otherwise stated as Genuine Cowhide Leather. Genuine
Cowhide Leather products are clearly stated as Genuine Cowhide Leather on our
furniture listings and on the Purchase Invoice.  

11.8 For all leather furniture products, there might be some natural scarring or
stains present as part of the manufacturing process. This might show up as
small round black dots on white leather upholstery to hide any natural scarring
of the leather. This is a characteristic of genuine leather during the
manufacturing process and is not a defect. There will be strictly no refunds or
exchanges allowed due to this reason.

11.9 The amount of wrinkles on any leather products are dependent on the design ,
upholstery tension or even the protective packaging. The wrinkles differ from
furniture to furniture even if for the same model. Wrinkles are not considered
a defect. There will be strictly no refunds or exchanges allowed due to this
reason.

11.10 Blended Leather is defined as genuine leather fibers mixed with a polyurethane
binder to achieve our signature leather look and hand feel for our Blended
Leather Range.

11.11 Our sofa base cloth is subjected to fair and reasonable use, natural wear and
tear or any accidental damages are strictly not covered under our furniture
warranty programme.

11.12 For all customise and build to order furniture products, in the event that we
have delivered the correct colour but incorrect upholstery material we will
offer compensation of up to 20% of your purchase price excluding any add on
charges (for example delivery charges) as all customise and build to order
furniture products are not refundable or exchangeable.

11.13 For any of our products where the cushioning system utilises spring coils or
high density foam, unless reported at the point of delivery the burden of proof
of defects will be borne by the Buyer. This is so as acts of misuse like
folding, bending, over loading (eg. 3 adults sitting on a 2 seater sofa
designed for 2 adults),standing or jumping may exert excessive strain and cause
permanent damage to cushioning spring coils and the cushioning foam which our
limited warranty does not cover. The Company will have full and final
discretion in determination of the facts.

11.14 Our Limited Warranty programme does not cover sofa spring coils as they are
subjected to fair and reasonable use. Any issues will only be accepted at the
point of delivery

11.15 Our Limited Warranty programme does not cover High Density Foam as they are
subjected to fair and reasonable use. Any issues will only be accepted at the
point of delivery

11.16 For Impact damages on High Density Foam at the point of delivery. You agree to
allow the High Density Foam up to 3 weeks to regain its natural shape. Damage
assessment and restoration repairs for High Density Foam will only be scheduled
3 weeks after the delivery.

11.17 All spring coils cushioning systems may also show
some body impressions as the upholstery and comfort layers settle and this is
not a structural failure or a manufacturing defect of your furniture. Rather these
are normal occurrences and indications that the upholstery and comfort
materials are conforming to your body contours. In accordance with
International Standards, impressions of upholstery materials of 1.5 inch or
less should not be considered as sagging of the cushioning.

11.18 All unedited photos of our furniture are taken to ensure accurate
representation of the products as much as possible. However, due to lighting or
photo taking constraints, product's actual colour may vary from the photo.
Sometimes it might be due to the different settings on your phone or computer,
your device’s screen resolution or your environmental lighting conditions when
viewing the photo. Different batches of production fabrics or leather swatches
may also vary slightly in colour or hue due to the natural dying process. We
cannot guarantee that the colour you see accurately portrays the true colour of
the product. If the furniture colour is of the essence, we recommend you buy
from a retail shop where you are able to view the physical furniture in person.
Any refund or exchange claims stating inaccuracy of colour representation in
our photos will not be accepted.

11.19 As different batches of production fabrics or leather swatches may vary
slightly in colour or hue due to the natural dying process. The colour you may
see from our Fabric Swatch Samples or Leather Swatch Samples might vary from
the actual sofa received.

11.20 The Company’s warranty does not apply if the product is used outdoors with the
exception of furniture that is designed specifically for outdoor usage.

11.21 Any product modification by the Buyer or other parties not authorised by Home
Atelier will void our Limited Warranty programme.

11.22 Our Limited Warranty programme does not cover items purchased as ‘Display
Pieces’ or designated as ‘AS IS’ at the time of purchase and products not
purchased directly from Home Atelier.

11.23 The Limited Warranty does not cover electronic devices embedded with our
furniture and we do not provide repair services for any electronic devices. In
the event of electronics devices which are malfunctioning at the point of
delivery, there will be a fixed compensation of $80 per malfunctioning
electronic device up to a maximum compensation of 10% of the furniture’s
invoice price

11.24 You agree that Home Atelier’s decision on all issues relating to complaints as to
defects either of workmanship or materials shall be final and conclusive. Any
decision to repair or replace any furniture shall be at Home Atelier’s sole
discretion.

11.25 Any item repaired under our Limited Warranty programme will be covered by the
limited warranty for the remainder of the original warranty period only. In the
event when there is a brand new replacement, the existing Limited Warranty will
end and our Limited Warranty programme will not be extended to the brand new
replacement furniture.

11.26 All brand new replacement furniture are available for self-collection only as
our Limited Warranty Programme do not cover any delivery costs

11.27 For servicing that is not covered under our Limited Warranty programme, charges
start at $90, and are subject to change depending on the items or parts which
needs to be serviced or replaced. Home Atelier reserves the right to impose
charges for additional materials if the required repair works involve the
procurement of materials which are not available at the time of request.

11.28 All repairs and service requests may take up to 12 months subject to the
procurement and availability of spare parts. We reserve the right to decline
any service requests which are not covered under our Limited Warranty programme
if the repair time might exceed 12 months.

11.29 In respect of manufacturing defects detected after our warranty period, the cost
of material components and replacement parts, with all labour charges and
transportation costs (if any) to be covered by the Purchaser. Any decision
to repair or have part(s) replaced shall be at Home Atelier’s sole discretion
subject to availability.

11.30 Any sofa which have a pull out sofa bed feature, the sofa bed frame is
subjected to fair and reasonable use and is not covered by our limited warranty
programme. Any defects must be reported to our furniture team on the day of
delivery. Unless stated otherwise in either our Purchase Invoice or Sofa Bed
Listing, all sofa beds have a per seat weight limit of 92kg per seat. For
example a Single or Super Single Sofa Bed have a total weight limit of 92kg
while A Queen or Super Queen size Sofa Bed will be able to support a combine weight
of 184kg distributed evenly over 2 Seats.

11.31 Our Sofa Beds are not designed to be permanent daily Bed Frame replacements
unless stated otherwise. Our Bed Frames have solid hardwood beam support
structures that are rated to 220kg compared to our Super Single Sofa Bed weight
limit of 92kg. The life span of your Sofa Bed may reduce significantly if used
as a daily Bed Frame replacement.

11.32 All our wood frame sofas have a weight limit of 92kg per seater unless stated
otherwise

11.33 Complimentary Delivery by Stairs Fees. In the event that our delivery by stairs
fee is waived. This is subjected to your furniture purchase being able to be
delivered by stairs. It is your responsibility to ensure that your furniture
dimensions allow your furniture purchase to be able to be delivered by stairs

11.34 Home Atelier or our Third Party Logistics providers will not be liable for any accidental
damages incurred if the furniture protective wrapping or furniture wood
protective frames have to be removed prior to entering the customer’s premises
doorway for any reasons.

11.35 All Build to Order products and Customized products are shipped from our
overseas factories without exception.

11.36 All complimentary free gifts offered by our Company are not covered by our
Limited Warranty programme or Accidental Damage Policy without exception.

11.37 Complimentary sofa pillows if listed in the Purchase Invoice is based on the
seater number of the sofa. For example a three seater sofa would typically have
only 3 complimentary pillows unless specifically informed otherwise.

11.38 All complimentary gifts have to be self-collected at our designated warehouses
without exception.

11.39 All complimentary gifts are subjected to availability and can be substituted
for other gifts without prior notice to you .  

11.40 For all furniture items which are purchased as part of a package discount
promotion, all the furniture items in that package promotion is strictly
non-refundable and non-exchangeable. In the event of any accidental damages
incurred during the delivery either by our delivery team or our third party
logistics providers we will either attempt to remedy the accidental damages
incurred or offer a cash compensation discount for any accidental damages.
There will be strictly no refunds or replacement of any package discount furniture
items.

11.41 For any furniture model that exhibits either a curvature design or any form of
non-linear design, if the upholstery choice is a relatively non-stretchable
fabric like leather there might be creases on the leather at the furniture
curvature points. This is not a defect or a workmanship quality issue. There
will be absolutely no refunds and returns for all build to order and customise
furniture attributing this as a reason.

11.42 For all customised furniture order products. Due to the nature of the
customisation process, there might be slight variances in design, sizing
proportions and colour when compared with our advertised listed pictures. While
every effort will be made to adhere to the original design, sizing proportions
and colour there will be strictly no refunds, replacements or discounts if they
are not exact replicas of our advertised listed pictures.

11.43 The standard seating height for all our in stock sofa furniture range between
40cm to 45 cm. We may accept customisation requests for sofa heights that will
exceed  this 45 cm seating height
provided that our furniture team have determined that it will not compromise
the integrity of the sofa frame. However sofas above 45cm seating height might
experience some swaying effects due to the increased height. This is not a
defect or a workmanship quality issue. There will be absolutely no refunds and
returns for all build to order and customise furniture for this reason.

11.44 For all Sofa Recliners purchased from 1 May 2021 which uses an electric motor
for reclining and warrantied by us. In the event we are unable to service or
repair the electric motor which is under warranty there will be a fixed
compensation payout of $450 for up to 2 seats electrically reclineable and a
fixed compensation payout of $600 for 3 seats and above that are electrically
reclinaeable that we are not able to service or repair.

11.45 The default stitch colour for all our Sofa Recliner models are white unless
listed otherwise. Any request for stitch colour other than white is subjected
to availability and can be reverted back to white stitches without prior
notice.

11.46 All our electric Sofa Recliners are able to be placed directly against the wall
when the recliners are not in used except for our Sofa Recliners with an
extendable sofa seating base. This applies to all sofa model made during and after
2022.

11.47 For all of our products made of  natural stone
(for example marble, granite etc). Due to the nature of the material, vein
patterns may vary from piece to piece and natural fissures may be present.
These are characteristics of natural stone tops as found in nature and are not
defects. There will be strictly no refund, exchange or requests for discount
base on the vein patterns or natural fissures found in any of our natural stone
products. For purchases of natural stone tables of 2 sets or more we will try
our best to match the vein patterns to the best of stock availability. There
will be strictly no exchange or refunds due to dissatisfaction of the vein
patterns.

11.48 For all our products made of sintered stone. Due to the nature of the material,
vein patterns may vary from piece to piece. This is characteristic of sinter
stone products and are not defects. There will be strictly no refund, exchange
or requests for discount base on the vein patterns of our sintered stone
products. For purchases of sintered stone tables of 2 sets or more we will try
our best to match the vein patterns to the best of stock availability. There
will be strictly no exchange or refunds due to dissatisfaction of the vein
patterns.

11.49 For all natural stone, sintered stone and wood furniture table tops. Only the
top side of the natural stone top, sintered stone top and wood top may be
polished.

11.50 Marble Sintered Stone is defined as Sintered Stone with a Marble Pattern on the
Sintered Stone Top. This is not natural marble. Sintered Stone has superior
heat resistant and scratch resistant qualities compared to Natural Marble.

11.51 For any of our table models which features any form of mechanical mechanism for
example extending mechanisms which allows a table top to be extended into
different positions including any hinging mechanisms. In the event we are
unable to service any mechanical mechanisms for any reasons during the warranty
period a fixed compensation of $100 will be compensated  for tables less than $1000 and a fixed
compensation of $150 for any tables that are purchased for $1000 and above will
apply.

11.52 For all Sofa Recliners including Motorised Sofa Beds purchased from 1 May 2022
onwards which uses an electric motor and warrantied by us. In the event we are
unable to service or repair the Sofa Recliner Electric Motor which is under
warranty there will be a fixed compensation payout of $450 for up to 2 seats
electrically reclineable and a fixed compensation payout of $600 for 3 seats
and above that are electrically reclinaeable that we are not able to service or
repair. For all Motorised Sofa Beds Electric Motors that we are unable to service
or repair there will be a fixed compensation payout of $550 for all size
categories.

11.53 For safety reasons, all sofa recliner chairs must be fully reclined back to the
upright seating position before standing up.

11.54 We do not use real gold or silver in any of our furniture items unless
specifically stated as such on our purchase invoice as either Genuine Gold or
Genuine Silver. Any description of gold or silver on any of our furniture
listing is achieved as such without the use of real gold or silver.

11.55 Gold Colour on any of our furniture models is achieved with our proprietary
gold colouration technique. There might be some discolouration of the gold
colour due to our proprietary manufacturing process. This is not a defect and
there will be absolutely no refund, exchange or discount due to any forms of
discolouration for any reason.

11.56 We do not use real diamonds or other precious stones in any of our furniture
items unless specifically stated otherwise as such on our purchase invoice as
Genuine Gemstone. Any description of diamonds in our furniture listing or
description is achieved with the use of synthetic materials.

11.57 For any of our furniture that utilises High Density Foam, High Density Foam is
compressible and as such its volume from furniture to furniture might vary.
This is not a defect and there will be strictly no refunds, replacements or
discounts due to this.

11.58 For all sofa bed models, our furniture team will only adjust the gap between
the sofa bed frame and the pull out sofa bed only when the sofa bed is not able
to be pulled out in full for use. The gap on either side of the sofa frame and
sofa bed might be slightly different to adjust for the cushioning and the
levelness of the pull out bed. This is not a defect and there will be strictly
no refunds, replacements or discounts due to this.

11.59 The per seat weight limit of a sofa is the total weight capacity of a sofa
divided by the total number of seats.

11.60 For furniture models which exhibit any form of curve design, there might be folds
or wrinkles of the sofa upholstery over the curve surfaces. This is not a
defect and there will be strictly no refunds, replacements or discounts due to
this.

11.61 All L-Shape sofa models are customised as the L-shape may be requested to be
either to the left or right hand side.

11.62 Our Limited Warranty programme only covers mechanical gear mechanism and does
not cover any metal or wood mounting systems on our furniture as they are
subjected to fair and reasonable use.

11.63 For any sofa models that exceed 220cm in length, we reserve the right to produce the sofa in 2 modular
units to be able to fit into most residential lifts.

11.64 Replacement sofa bed mattresses are subjected to stock availability and
production may be discontinued at anytime

11.65 Our furniture connecting latch system for sofas is subject to change as our
furniture production team will assess the right latch system for your furniture
base on its weight and seat capacity and may differ from the listing photo.

11.66 Sofas which have a connecting latch system installed might be unbalanced and
prone to rocking if used without the latch system.

11.67 Leather-Aire is our proprietary woven fabric which is made to look and feel
like Leather but offers water repellent and scratch resistant properties. These
properties can be compromised by the use of detergents, abrasives or any harsh
cleaning agents.

11.68 Leather-Aire is our proprietary woven fabric and it does not utilizes any
genuine cowhide leather products

11.69 For all Leather products, proper care and maintenance is needed to preserve the
state of the leather. For example leather moisturising cream needs to be
applied periodically to prevent  cracking
and peeling of the leather when it starts to dry out due to external
environment factors. We are not responsible for any cracking and peeling of the
leather if proper care and maintenance is not exercised. Cracking and peeling
are strictly not covered by our Limited Warranty programme.

11.70 The payment of Delivery by Stairs Fee to us does not guaranteed our delivery
team will be able to deliver your furniture by stairs. In exceptional cases
where our delivery guys deem on site that delivering your furniture might
likely result in injury to them or damages to the furniture, the furniture will
be delivered to the ground floor or be taken back to our warehouse and the
Delivery by Stairs Fee will be refunded to you within 3 business days.

11.71 It is your responsibility base on the dimensions of your furniture purchase
that your furniture purchase would be able to be delivered via stairs. There
will be strictly no refunds for both Build to Order and Customised furniture
products if they are unable to be delivered because our delivery are unable to
deliver your furniture via stairs.

11.72 It is your responsibility base on the dimensions of your furniture purchase , your
lift door dimensions and your entrance door way dimensions to determine if your
furniture is able to be delivered to your delivery address. There will be
strictly no refunds for both Build to Order and Customised furniture products
if they are unable to be delivered because they could not fit into your lift or
entrance door way.

11.73 Base on your delivery address entrance doorway and lift doorway measurements,
our sales team or logistics team may make recommendations on your furniture’s
suitability for delivery. This is just an approximation and is not a guaranteed.
It is your responsibility base on the dimensions of your furniture purchase and
your entrance doorway dimensions and your lift doorway dimensions to determine
if your furniture is able to be delivered to your delivery address. There will
be strictly no refunds for both Build to Order and Customised furniture
products if they are unable to be delivered because they could not be delivered.

11.74 Our sales team may make recommendations for a range of sofas which may
accommodate a variety of robot vacuum cleaners to enter and clean the floor
area directly below your sofa. This is not a guaranteed from us that it will
definitely be able to do so for your particular robot vacuum cleaner as robot
vacuum cleaners do vary in height and dimensions. There will be strictly no
refunds or exchanges for both Build to Order and Customised furniture products
if your robot vacuum cleaners  are unable
to enter the floor area below your sofa.

11.75 The power sockets and power cables that come with your furniture is determined
by the country of manufacture. They will take after the country of
manufacturer’s electrical standards.

11.76 Cables and adapters for USB charging ports do not come with your sofa purchase
unless specifically stated otherwise.

11.77 All Cat Proof Scratch Resistant Fabrics and Cat Proof Scratch Resistant
Leather-Aire are very scratch resistant for cats under the ages of 15 months but
scratches might still occur. Use of these fabrics and materials are subjected
to fair and reasonable use. They are scratch resistant but are still able to be
scratched. There will be strictly no refunds or exchanges due to scratch marks.
Scratches are not covered under our Limited Warranty programme.

11.78 Down Feathers are made with synthetic down feathers unless stated otherwise as
natural down feathers

11.79 Latex thickness are always given as an approximation as they are by nature
highly compressible

11.80 The majority of our Boucle Fabric is knitted to achieve the textured look. This
is subjected to fair and reasonable use and any misalignment of the knitting
will not be accepted other than at the point of delivery. 

11.81 All spring systems including but not limited to our coil spring or serpentine
springs systems are subjected to reasonable and fair use. They are not covered
under our furniture limited warranty programme.

11.82 Distressed Vintage Leather is defined as either genuine cowhide leather or faux
leather manufactured to look weathered , aged and creased as opposed to looking
new and pristine without creases. This is done deliberately to give it a
vintage well used look.

11.83 Our range of Water Repellent Fabric is subjected to fair and reasonable use and
are quite anti-water absorbent for small splashes of water but they still
absorb water if directly exposed to water for prolonged periods of time and may
leave stain marks.

11.84 Our in stock warehouse inventory changes periodically without notice. Furniture
models which are not in stock are all build to order and will be stated as such
on your Purchase Invoice.

11.85 For greater time efficiency, certain furniture models will be either fully or
partially installed before they are delivered to you. This would be decided at
our furniture team’s discretion.

11.86 All promotional price furniture items for example but not limited to Chinese
New Year Promotion, Hari Raya Promotion, Deepavali Promotions and 12.12
Promotions are strictly non-refundable or exchangeable for other furniture
models.

11.87 Deposit payment paid for all promotional price furniture items for example but
not limited to Chinese New Year Promotion, Hari Raya Promotion, Deepavali
Promotions and 12.12 Promotions are strictly non-refundable.

11.88 If a deposit is placed to reserve a furniture product , you must confirm
all  purchase details no later than 90
days after deposit is paid failing which your order will be treated as
abandoned and your deposit forfeited

11.89 If a balance payment is required before any furniture production, any
outstanding amount not paid within 45 days of deposit payment date will lead to
the forfeiture of the deposit payment without any exceptions

11.90 Any furniture purchases made with a Credit Voucher is strictly non-refundable.

11.91 Unless otherwise stated on our listing, all furniture purchases from us comes
with our 6 months Limited Warranty.

11.92 Unless otherwise stated by us, all requests or instructions from you must be in
writing and communicated to us either by email or via what app. We may choose
to accept instructions from you over the phone, however any non-written
instructions shall be given to us at your risk and we shall not be responsible
for any loss or damage you may suffer.

11.93 For purchases that are made after 3pm, The Purchase Invoice and the terms and
conditions may be only emailed on the next business day.

11.94 Communication and notices sent by electronic media such as electronic mail and
Whats App messaging shall be considered to have been sent and received by you
on the same day. Communication and notices sent by postal mail shall be
considered to have been delivered on the day immediately after the day of
posting if sent by post in Singapore and considered delivered 5 days after the
date of posting if sent outside of Singapore.

11.95 For any Build to Order or Customised Furniture Product, if we have erred and
omitted any product specification or feature as stated in our Sales Purchase
Invoice. The price differential of the omitted product specification or feature
will be refunded in full. There will be strictly no refunds or exchanges for
Build to Order and Customised Furniture Products as a result of any specification
or feature omission. There will also be strictly no compensation for any direct
or indirect consequential losses and costs as a result of the furniture
specification or feature omission.

11.96 For all customers using any Instalment Payments, the full purchase price of the
furniture order must be paid within 90 days of the first instalment payment
deduction if at the first instance the full purchase price of the furniture
order was not paid at the start. Failing which we reserve the right to forfeit
the existing payments paid and to cancel your order.

11.97 For all customers who have placed a deposit for our furniture production team
to commence furniture production pending further payment at a later stage of
the furniture production. Your order will be cancelled and your deposit will be
forfeited if the outstanding payment agreed upon is not paid within 30 days of
the agreed payment day.

11.98 Delivery times are always given as an estimate only and are subjected to
shipping delays. They do not include public holidays in Singapore , China or
Malaysia where our furnitures are made. Any public holidays would have to be
added on to our estimated delivery timings. The longest closure being the
Chinese New Year Holidays. Our Malaysia Factory will close for up to 3 weeks
while our China Factory will close for up to 4 weeks.

11.99 Delivery times for any country celebrating Hari Raya but not limited to Dubai
and Malaysia, during the month preceding and just after Hari Raya. Shipping
times are given as an estimate only and are subjected to change at any moment.

11.100 All furniture deliveries to commercial addresses shall automatically implies
that the furniture is purchased for commercial use. Our Limited Warranty
programme strictly do not cover any furniture that is used in a commercial
setting without exceptions .

11.101  In the event of any dispute or issues with
any of our furniture supplied by our furniture suppliers which could not be
resolved by us, you agree to pursue the issue directly with our furniture
supplier and exclude us from any legal proceedings.

11.102  In the event of any dispute or issues concerning
with any of our third party logistics contractors which could not be resolved
by us, you agree to pursue the issue directly with our third party logistics
contractor and exclude us from any legal proceedings. This includes damages to
your furniture purchased or your property.

11.103 International Furniture Purchases are defined as furniture purchases delivered
to other than the country of manufacture.

11.104 All the pricing for services in this Terms & Conditions are accurate at the
time of publishing and are subject to change without prior notice to you.

11.105 We do not provide any furniture photo taking services at our furniture
production workshop or our warehouses without exception

11.106 Our Home Visit Promotion $400 is valid for 30 days from the Home Visit Appointment date for any sofa purchases.  

11.107 All our staff have the right not to be subjected to any behaviour or verbal abuse
that includes threats of physical harm and violence, inappropriate religious or
racial insults, homophobic or other derogatory remarks. In this event, we
reserve the right not to provide any delivery services, assembly services or
furniture disposal services. Any fees collected for these services will be
refunded. If any of these services are advertised as free or as part of a
furniture package price a fix amount of $55 will be refunded to the customer
and the furniture bought will only be available for self-collection at either
our warehouse or at our third party logistics warehousing facilities. Any
future correspondence with the customer will be restricted to email only.
